3.1 Overview

This website is operated by Paw Vitals ("we", "us", "our"). By accessing or using this website, browsing, or placing an order, you agree to be bound by these Terms of Service and all policies referenced within them, including our Privacy Policy, Refund & Returns Policy, and Shipping Policy.

If you do not agree to these terms, please do not use this website.

3.2 Eligibility

By using this site you confirm that you are at least 18 years of age, or that you are using the site under the supervision of a parent or guardian, and that you have legal capacity to enter into a binding contract.

3.3 Products and Descriptions

We make every effort to display our products and their colours accurately. However, we cannot guarantee that your device's display renders colours accurately, and product images are illustrative.

We reserve the right to modify, discontinue or limit the availability of any product at any time without notice.

Product descriptions are provided in good faith and are intended to be accurate. Where a description contains an obvious typographical error or pricing mistake, we reserve the right to cancel the affected order and issue a full refund, even after order confirmation.

3.4 Health and Wellbeing Disclaimer

Paw Vitals products are comfort, enrichment and lifestyle products for animals. They are not veterinary medical devices and are not intended to diagnose, treat, cure, or prevent any medical or behavioural condition.

References on this site to anxiety, joint health, arthritis, hydration, sleep quality or similar are general wellbeing statements and must not be treated as veterinary advice.

If your pet is unwell, in pain, or exhibiting significant behavioural change, consult a registered veterinarian. Do not delay seeking veterinary care because of anything you have read on this website.

You are responsible for supervising your pet's use of our products and for selecting a size and product appropriate to your animal.

3.5 Pricing and Payment

All prices are listed in New Zealand Dollars (NZD) and are inclusive of GST where applicable.

We reserve the right to change prices at any time without notice. Price changes do not affect orders already confirmed and paid.

Payment is required in full at the time of order. We accept the payment methods displayed at checkout. By submitting payment information, you represent that you are authorised to use the payment method provided.

We reserve the right to refuse or cancel any order, including where we suspect fraud, an unauthorised transaction, a pricing error, or a breach of these terms.

3.6 Order Acceptance

Your order is an offer to purchase. A contract is formed only when we dispatch the goods and send you a dispatch confirmation. Receipt of an order confirmation email does not by itself constitute acceptance.

3.7 Reviews and Customer Content

Product reviews displayed on this site are collected through Judge.me from customers who have purchased the relevant product.

If you submit a review, comment, image or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, display and distribute that content in connection with our business, including in marketing.

You warrant that any content you submit is your own, is accurate, and does not infringe the rights of any third party. We reserve the right to remove content that is unlawful, misleading, offensive, or otherwise inappropriate.

3.8 Intellectual Property

All content on this website — including text, graphics, logos, images, product photography, page design and the "Paw Vitals" name and branding — is owned by or licensed to us and is protected by New Zealand and international intellectual property law.

You may not reproduce, distribute, or create derivative works from any part of this site without our prior written consent.

3.9 Acceptable Use

You agree not to use this website:

For any unlawful purpose or to solicit others to unlawful acts;
To transmit malware, viruses, or malicious code;
To scrape, harvest, or collect data about other users;
To interfere with or circumvent the security features of the site;
To submit false or misleading information.

We reserve the right to terminate your access for breach of this section.

3.10 Third-Party Services

This website uses third-party services including Shopify (hosting and payments), Judge.me (reviews), and analytics and advertising providers such as Meta. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the content or practices of third-party services.

3.11 Limitation of Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable New Zealand law that cannot lawfully be excluded.

Where you acquire goods from us for the purposes of a business, the Consumer Guarantees Act does not apply, and to the maximum extent permitted by law our liability is limited to, at our option, replacing the goods or refunding the purchase price.

To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profit or loss of opportunity, arising from your use of this website or our products.

3.12 Indemnity

You agree to indemnify and hold harmless Paw Vitals, its owners, contractors and agents from any claim or demand, including reasonable legal fees, arising from your breach of these Terms of Service or your violation of any law or the rights of a third party.

3.13 Privacy

Your use of this website is also governed by our Privacy Policy, which explains how we collect, use and store your personal information in accordance with the Privacy Act 2020.

We may update these Terms of Service at any time. The current version is always available on this page, and the "Last updated" date reflects the most recent revision. Your continued use of the site after changes are posted constitutes acceptance of those changes.

3.15 Governing Law

These Terms of Service are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the New Zealand courts.

3.16 Severability

If any provision of these terms is found to be unlawful or unenforceable, that provision is severable and does not affect the validity of the remaining provisions.
